1. Agreement to Terms

By accessing or using CashFish's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

CashFish provides a financial operating system that consolidates document processing, bookkeeping, CRM, vendor management and financial analytics. These terms govern your use of our platform and services.

2. Description of Service

CashFish provides the following services:

• Automated financial document processing and extraction from connected sources
• Bank account and payment integration synchronization, where supported by your plan
• Customer relationship management (CRM) tools
• Vendor and contract management
• Financial insights, forecasts and recommendations
• Revenue, expense, and profitability analytics

3. User Accounts

To access certain features of our service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and complete
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Trial, Subscription and Billing

4.1 Subscription Plans: CashFish offers multiple subscription tiers (Starter, Growth, Scale, and Teams) with monthly or annual billing options.

4.2 Free Trial: Every plan begins with a 4-day free trial of the full platform. Your paid subscription begins automatically at the end of the trial unless you cancel beforehand.

4.3 Payment: You agree to pay all fees associated with your selected plan. Payments are processed through our secure third-party payment processor, Stripe.

4.4 Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel at any time through your account settings.

4.5 Price Changes: We reserve the right to modify subscription prices with 30 days notice. Existing subscribers will be notified before price changes take effect.

4.6 Refunds: We offer a 4-day money-back guarantee. Cancellations within 4 days of initial subscription will receive a full refund. See our Refund Policy for details.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Use automated systems to access the service without authorization
• Reverse engineer, decompile, or disassemble any part of the service
• Share your account credentials with others
• Upload malicious code or viruses

6. Intellectual Property

The service and its original content, features, and functionality are owned by CashFish and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the data you upload to CashFish. By uploading content, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing our services.

7. Data Ownership and Privacy

Your financial data belongs to you. We process your data only to provide our services and will never sell your data to third parties. Our data handling practices are detailed in our Privacy Policy.

• You own all data you input into CashFish
• You can export your data at any time
• We use bank-level encryption to protect your data
• We will delete your data upon account closure (subject to legal retention requirements)

8. Connected Accounts & Third-Party Integrations

CashFish integrates with third-party services (email providers, banks, payment processors, e-commerce platforms, CRMs and storage services). By connecting a source, you authorize CashFish to access it as described at the time of connection — email and bank connections are read-only — and you can disconnect any source at any time from your settings.

Your use of these integrations is subject to the third parties' terms of service. We are not responsible for third-party services or their availability.

9. Disclaimers and Limitations of Liability

9.1 Service Availability: We strive for 99.9% uptime but do not guarantee uninterrupted service. The service is provided "as is" without warranties of any kind.

9.2 No Professional Advice: CashFish provides insights and recommendations but does not provide financial, tax, accounting or legal advice, and is not a substitute for a qualified professional. We are not liable for financial decisions made based on our recommendations.

9.3 Limitation of Liability: To the maximum extent permitted by law, CashFish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9.4 Automated Processing & Your Review: Extraction, categorization, forecasts and insights are generated by automated systems and may contain errors or require verification. You remain responsible for reviewing and approving extracted financial information before relying on it. Forecasts and projections are estimates based on your data, not guarantees of future outcomes.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the service will immediately cease. You may cancel your subscription at any time through your account settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the service will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the modified terms.
